 CIRCULAR

ON INTRODUCTION OF THE LIST OF MACHINERY, EQUIPMENT AND MATERIALS SUBJECT TO OCCUPTIONAL HYGIENE AND SAFETY REQUIREMENTS

Pursuant to the Law No. 84/2015/QH13 on Occupational Hygiene and Safety dated June 25, 2015;

Pursuant to the Government’s Decree No.44/2016-ND-CP dated May 15, 2016 detailing a number of Articles of the Law on Occupational Hygiene and Safety regarding technical safety inspection, training of occupational hygiene and safety and occupational environment monitoring;

Pursuant to the Government’s Decree No. 106/2012/ND-CP dated December 20, 2012, defining the functions, rights, responsibilities and organizational structure of the Ministry of Labor, War Invalids and Social Affairs;

Upon request of the Director of the Department of Labor safety;

The Minister of Labor, War Invalids and Social Affairs hereby issues this Circular introducing the List of machinery, equipment and materials subject occupational hygiene and safety requirements.

Article 1. The list of machinery, equipment and materials strictly subject to occupational hygiene and safety requirements

The list of machinery, equipment and materials subject to occupational hygiene and safety requirement is issued herewith.

Article 2. Implementation organizations

  1. According to socio-eco development and State management requirements, the competent Ministries that have the power to manage machinery, equipment and materials subject to occupational hygiene and safety requirements (hereinafter referred to as “the List”) as stipulated in Article 33 of the Law on Occupational Hygiene and Safety submit written requests or proposals for supplement and modification to the List to the Ministry of Labor, War Invalids and Social Affairs. To be specific:

– Name of machinery, equipment and materials deemed necessary to added to the List, including its scientific name and trade name ( if any);

– The necessity, feasibility and impact of addition and modification to the List ( enclosed with draft inspection procedures, if any).

  1. The Department of Labor safety shall aggregate and submit proposals for modification and addition to the List to the Ministry of Labor, War Invalids and Social Affairs as prescribe by laws.
  2. Departments of Labor, War Invalids and Social Affairs of provinces and centrally-affiliated cities (hereinafter referred to as “province”) shall cooperate with relevant authorities in dissemination and provisions of instructions on implementation of this Circular for entities using machinery, equipment and materials on the List within the province; aggregate and submit annual status reports on implementation of this Circular and status reports on occupational hygiene and safety to the Ministry of Labor, War Invalids and Social Affairs.

Article 3. Effect

  1. This Circular enters into force form February 12, 2017.
  2. Circular No. 05/2014/TT-BLDTBXH dated March 06, 2014 by the Ministry of Labor, War Invalids and Social Affairs on introduction of the list of machinery, equipment and materials subject to occupational hygiene and safety requirements shall expire from the effective date of this Circular.
  3. Any issue arising in connection with implementation of this Circular should be reported in writing to the Ministry of Labor, War Invalids and Social Affairs. /.

LIST

OF MACHINERY, EQUIPMENT AND MATERIALS SUBJECT TO OCCUPATIONAL HYGIENE AND SAFETY REQUIREMENTS
(Issued together with the Circular No.53/2016/TT-BLDTBXH dated December 28, 2016 by the Ministry of Labor, War Invalids and Social Affairs)

No. MACHINERY, EQUIPMENT AND MATERIALS SUBJECT TO OCCUPATIONAL HYGIENE AND SAFETY REQUIREMENTS
Section I Machinery, equipment and materials subject to occupational hygiene and safety requirements
1  Boilers, of all types, (including superheaters and heating settings) working under the pressure of over 0.7 bar; water heaters for the temperature of exceeding 115°C.
2  Oil heating boilers
3 Class-I and class-II pipeline for vapor and hot water with the outer diameter of 51 mm or more, and class –III and class-IV pipeline with the outer diameter of 76 mm r more as classified in the TCVN 6158:1996 and TCVN 6159:1996.
4 Pressure vessels capable to work under the pressure of exceeding 0.7 bar ( excluding hydrostatic pressure) as classified by TCVN 8366:2010 and pressure vessels capable to work under the pressure of exceeding 210 bar
5 Tanks for storage and transport of liquefied gas, liquefied petroleum gas, compressed natural gas or liquid under the pressure of exceeding 0.7 bar or storage and transport of liquid and powder under no pressure but may be capable to work under the pressure of exceeding 0.7 bar after separation as classified by TCVN 8366:2010.
6 Bottles for storage and transport of compressed gas, liquefied gas, natural liquefied gas, liquefied petroleum gas and dissolved gas under the pressure of exceeding 0.7 bar
7 Systems supplying, preparing and fueling compressed gas, liquefied gas, liquefied petroleum gas and dissolved gas.
8 Fixed gas pipeline systems, pipelines, and underwater gas pipelines and medical gas pipeline systems.
9 Refrigerating system as classified in TCVN 6104:2015, except for those using water and air as refrigerant; refrigerating systems using less than 5kg class-I refrigerants and less than 2.5kg class-II refrigerants; refrigerating systems using class-III refrigerants
10 Cranes of all types such as automobile cranes, wheel-mounted cranes, crawler cranes, tower cranes, railway cranes and derrick cranes
11 Bridge cranes , of all types, such as rolling beam cranes and suspension cranes
12 Gantry crane, of all types, including gantry cranes and semi-gantry cranes.
13 Cable cranes for transport of goods and/or passengers; construction vehicle-mounted cranes, tilt hoists and vertical hoists
14 Electric pulleys; manual pulleys with the lifting load of 1,000 kg or more.
15 Electric winches for railways.
16 Electric hoists for incline lifting; lifting platforms, lifting base; lifting base for lifting of people; hoists for lifting people.
17 Manual hoist with the load capacity of 1,000 kg or more
18  Forklift trucks powered by engine for lifting of cargoes with the load capacity of 1,000 kg or more.
19 Forklift trucks for lifting of people: Self-propelled forklift trucks, forklift trucks using hydraulic transmission and manual transmission for lift people upwards exceeding 2m.
20 Hoists for lifting goods and/or people; construction hoists.
21 Elevators of all types.
22 Escalators and conveyors for transport of people
23 Mobile stages
24 Gaming devices: Gliders, giant wheels and chutes with the height of lifting of 2 meter from the fixed platform or more at the speed of 3m/s, except for those for sporting purposes.
25 Cab cars for transport of people
26 Hoists with the load capacity of 1,000 kg or more for use in mining.
27 Single hydraulic props, mobile frames and self-propelled supporting frames used in pit mining
28 Internal combustion engine (with the calcite volume of 0.6 m3 or the cylinder diameter of exceeding 200mm).
29 Anti-explosion transformers
30 Explosion proof electric engine
31 Explosion-proof distributor and breakers (magnetic starters, soft starters, automatic circuit breakers, inverters and earth leakage relays)

 

32 Explosion-proof remote control (pushbuttons, control panels)
